NEWS: OPM Issues Guidance on Federal Minimum Wage
WASHINGTON, DC - The U.S. Office of Personnel Management (OPM) has issued guidance to agencies in response to an increasing number of state and local governments establishing or increasing a jurisdictional minimum wage higher than the nationwide federal minimum established under the Fair Labor Standards Act (FLSA).
Federal employees are covered by the FLSA, which is federal law, and it includes minimum wage provisions. The FLSA minimum wage supercedes any higher wage established by state or local governments.
State and local government minimum wage laws are not binding on the Federal government and its components since, under the preemption doctrine which originates from the Supremacy Clause of the Constitution, Federal law supercedes conflicting state law.
