Yes. Telework denial decisions should be made on a case-by-case basis, based on the operational needs of the organization, and in accordance with the requirements of the Act and the agency’s telework policy. When deciding to terminate a telework agreement, a manager should document and demonstrate the reasons for the termination. In the case of termination for diminution of employee or agency performance, the agency should document that:

  • The employee’s teleworking directly and negatively impacts the employee’s performance or the performance of the work group/organization; and
  • Remediation can best be accomplished by terminating the telework arrangement.
